2. Description of Service
Cardly provides a mobile application that allows users to create and send handwritten cards. Our service includes:
- AI-powered message generation
- Card template selection
- Card printing and mailing through our fulfillment partners
- Order tracking and history
3. User Accounts
You are responsible for maintaining the confidentiality of your device and any activities that occur through your use of the app. You agree to provide accurate information when using our services.
4. Orders and Payments
When you place an order through Cardly:
- You agree to pay the stated price for the card and any applicable fees
- Payment is processed securely through Stripe
- Orders are final once submitted for fulfillment
- We reserve the right to refuse or cancel orders at our discretion
5. Shipping and Delivery
We deliver cards to addresses within the United States. Delivery times are estimates and may vary based on postal service conditions. We are not responsible for delays caused by incorrect addresses or postal service issues.
6. Refunds and Cancellations
Due to the personalized nature of our products:
- Orders cannot be cancelled once submitted for fulfillment
- Refunds may be issued for cards that are lost, damaged, or significantly different from what was ordered
- To request a refund, contact our support team within 30 days of your order
7. Acceptable Use
You agree not to use Cardly to:
- Send cards containing illegal, harmful, threatening, abusive, or harassing content
- Send cards that infringe on intellectual property rights
- Send cards for fraudulent or deceptive purposes
- Impersonate any person or entity
- Violate any applicable laws or regulations
We reserve the right to refuse fulfillment of any card that violates these terms.
8. Intellectual Property
The Cardly app, including its design, features, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.
9. AI-Generated Content
Our AI message generation feature provides suggestions based on your input. You are responsible for reviewing and approving the final message content before sending. We do not guarantee that AI-generated content will be appropriate for all situations.
10. Limitation of Liability
To the maximum extent permitted by law, Brief.ai, Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the specific order in question.
11. Disclaimer of Warranties
Our services are provided "as is" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, error-free, or completely secure.
12. Changes to Terms
We may modify these Terms at any time. We will notify users of significant changes through the app or via email. Your continued use of Cardly after changes constitutes acceptance of the modified Terms.
